Any use of the SupremeGiftBaskets.com web site is subject to the user agreeing to the following TERMS AND CONDITIONS OF USE set forth by SupremeGiftBaskets.com. Please read this document in its entirety before purchasing any item through the SupremeGiftBaskets.com web site.

Shipping Policies

Shipping is via UPS ground shipping service. Each order will have an associated USPS tracking number. This tracking number will be emailed to you once the order has shipped. You can also view the tracking number details and order status once logged in at SupremeGiftBaskets.com under 'My Account' and 'Orders'.

We endeavour to ship all orders as quickly as possible. Generally products ship within 2 business days. Shipping occurs Monday through Friday only. No shipping or deliveries occur on Saturday or Sunday. Orders placed on Saturday and Sunday will typically ship Monday or Tuesday.

We do not currently offer shipping to APO, FPO or PO Boxes.

Incorrect Address and Changes To Orders

All orders must be complete with the correct address, city, state and zip. SupremeGiftBaskets.com will not be responsible for a gift being mis-delivered or being delivered late when a bad address is supplied. We will ship to the address supplied on the order. • A $14.50 Fee will apply when a bad address is supplied and the carrier needs to make an address correction or when a suite number/ apartment number is not supplied. This fee may and will be incurred any time a zip code, city and state do not match. • Claims or requests for refunds on gifts returned due to a bad address will not be honored.

All communication regarding orders must be received by email to sales@supremegiftbaskets.com. SupremeGiftBaskets.com customer service personnel are not authorized to make changes or cancellations to orders at any time over the phone. We will endeavour to make changes to orders which have not been processed. Changes received to orders after on the orders processing day may not be possible to correct.

Credit Cards and Payments

We accept Visa, MasterCard, American Express, Discover Card and eCheck via PayPal. Please review their policies before proceeding to checkout. SupremeGiftBaskets.com is not responsible for the actions of third parties. Please note that SupremeGiftBaskets.com is part of the Vendhost group and that VENDHOST will appear on your statement for purchases made at SupremeGiftBaskets.com.

Claims & Returns

All damage claims, discrepancies or issues of any kind must be made within 3 business days of the gift being received. There will be No exceptions to this policy. If a gift arrives damaged or there is a discrepancy in the gift ordered and what was received SupremeGiftBaskets.com will make every effort to resolve the issue in a timely manner and to your recipients satisfaction if and when this issue is reported within 3 business days. Credits and or refunds will be at the sole discretion of SupremeGiftBaskets.com and will only be issued if damaged gifts or discrepancies can be verified by the carrier. If your recipient disposes of the gift before we can verify the damages/discrepancy we will not issue any refund. All claims must be issued in writing by e-mail. Claims will not be accepted via the phone.

If the gift is simply not wanted, or the customer is not satisfied for any other reason other than a SupremeGiftBaskets.com error they may ship it back to us at their own expense as long as it shipped back within 3 days of being delivered. A partial refund on the merchandise amount only will be offered. Original shipping is not refunded. The refund is based on the gifts perish ability and condition upon being returned. The gift must be unopened, untampered with and shipped back within 3 days of being received. If the gift is damaged in any way which includes but is not limited to heat damage, or we have made an error in sending the incorrect gift: We will call tag the original gift and either ship a new one or refund the gift in full once the original gift has been retrieved. However, if we cannot call tag the original gift no refund or credit will be offered. Retrieving the original gift is the only way we have of verifying the recipients claim or placing a claim with the carrier if necessary.

In the event that items or pieces are missing, damaged, stale, melted or similar claims SupremeGiftBaskets.com will need the following information from the original box to begin to process your claim. All SupremeGiftBaskets.com gifts have batch codes on them and are checked by two line personnel. We will need all three lines of information off of the 1 x 2 5/8 white label off of the side/ bottom of the original shipping box, not the UPS label. We can not assist you in your claim without all of this information.

Gifts delivered late or not according to the time in transit map may receive a partial shipping refund based on the circumstances. There will be no discount or refund on the gift itself when delivered late and a gift may not be returned due to a late delivery.

Substitutions and Returns

We do reserve the right to make substitutions and do find the need to at various times throughout the year. Not all packaging may look identical to the products photographed as designer packaging does change quite frequently. Please be aware that at times substitutions of a variance in flavor, fragrance or packaging will occur. Refunds, discounts or a new gift being shipped will not be offered due to a substitution. You agree to occasional substitutions by placing your order with us. We do not notify clients prior to component substitutions being made. If for any reason other than damages or errors on the part of SupremeGiftBaskets.com, a customer wants to return a gift they may do so at their own expense within 3 days of the gift being delivered. Original shipping charges are not refundable.

If SupremeGiftBaskets.com has committed an error (excluding substitutions within standard parameters) or a gift is damaged in transit SupremeGiftBaskets.com will retrieve the gift and refund it in full or re-ship it. However we do not at any time allow recipients to keep a gift and receive a new one or a complete refund. For us to assist you the original gift must be retrieved. Discounts will not be offered, retrieving the gift and re-shipping or refunding are the only options.

Order Acceptance

Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. SupremeGiftBaskets.com reserves the right at any time after receipt of your order to accept or decline your order for any reason.

Out-of-Stock Products

There may be times when the product you have ordered is not available to ship which will delay fulfilling your order. We will keep you informed of any products that you have ordered that are out-of-stock and unavailable for immediate shipment.

Fulfillment

SupremeGiftBaskets.com will make every effort to ship and fill all orders received. However if an order can not be filled SupremeGiftBaskets.com will notify the customer as soon as possible. Additional credits will not be offered in the event we can not fill an order.

Holidays/ Closures

Please take note that we are closed and no shipping will occur on the following days. All orders due to ship on these days will ship the next operating business day.

  • July 3rd, July 4th and July 5th 2017 in observance of Independence Day
  • September 1st and September 4th, 2017 in observance of Labor Day
  • November 23rd and 24th, 2017 in observance of Thanksgiving
  • December 22nd, 25th and December 26th 2017
  • December 30th, 2017 in observance of New Years
  • January 1st and 2nd 2018 in observance of New Years

Orders placed before 1 PM CST on 12/19/2017 are guaranteed to ship prior to Christmas. (Please take into consideration the 2-3 day lead time on orders during the month of December.) Orders placed after 1 PM CST on Tuesday 12/19/2017 are not guaranteed to ship prior to the holiday closing. We will continue to ship orders out in the order in which they were received and make every effort to ship every order we receive through Wednesday 12/20/2017 by 10 AM CST.

Other Conditions

These Conditions will supersede any terms and/or conditions you include with any purchase order, regardless of whether SupremeGiftBaskets.com signs them or not. We reserve the right to make changes to this site and these Conditions at any time.

Typographical Errors

In the event a product is listed at an incorrect price or description due to typographical error or errors in information received from our suppliers, SupremeGiftBaskets.com shall have the right to refuse or cancel any orders placed for the products listed at the incorrect price. SupremeGiftBaskets.com shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, SupremeGiftBaskets.com shall immediately issue a credit to your credit card account in the amount of purchased price.

Personal Information

Your personal information will be used for the purpose of processing each order submitted through the SupremeGiftBaskets.com web site. We will however, release information to comply with law; enforce or apply our Conditions of Use and other agreements; or protect the rights, property, or safety of SupremeGiftBaskets.com, our users, or others. This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction. Liability and Indemnity

You understand that under no circumstances shall SupremeGiftBaskets.com, the SupremeGiftBaskets.com web site or any of the companies listed in the SupremeGiftBaskets.com be liable for any damage to your computer or your software that might have resulted however direct, indirect or incidental from your use of the SupremeGiftBaskets.com web site or access to the internet.

You expressly and irrevocably agree that our total aggregate liability to you for any proven losses, damages and claims in connection with the provision or use of Services or this Agreement, including liability for breach of contract, negligence, tort, or any other common law or statutory action, shall be limited to the charges paid to us by you in respect of the Services which are the subject of any such claim. You agree to defend, indemnify and keep indemnified and hold us harmless from any:

  • loss of business, contracts, profits or anticipated savings;
  • other indirect or consequential or economic loss whatsoever;
  • injury to person or property allegedly caused by any products sold or otherwise distributed in connection with us;
  • negligence, misconduct, or breach of this agreement by you;
  • incomplete, inadequate or otherwise problematic use of any Services by you;
  • omission or failure by you to obtain appropriate advice, including legal advice, in respect of any Services or this Agreement prior to making a purchase;
  • incomplete, inadequate or lack of knowledge and experience necessary for use of any Services;
  • damages including but not limited to indirect, special, incidental, consequential or exemplary damages allegedly arising out of, resulting from, incidental to, or in connection with this Agreement or Services.
